Terms & Conditions of use of Mazuki Taekwon-Do Schools

A Mazuki Taekwon-Do School is one whereby students/instructors follow the Mazuki training programme in line with the International Taekwon-Do Federation. These terms and conditions apply to the use of this website; all transactions placed with Mazuki schools; the codes of conduct of student/instructor members and visitors to Mazuki Taekwon-Do School venues. Contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights.

By enrolling with Mazuki Taekwon–do all students agree to be bound by the terms and conditions as set out herein.
These terms and conditions are applicable to all members (namely students/instructors/parents/guardians) and must be abided with, failing which their membership will be withdrawn and cancelled. Further, these Terms and Conditions govern the administration and management of Mazuki Taekwon–do. Management can be emailed on info@www.mazuki.com

Changes To The Terms And Conditions

Mazuki Taekwon–Do reserves the right to update and change the Terms and Condition from time to time without notice. The most current version of the Terms and Conditions can be reviewed herein on this website. Any changes to the Terms & Conditions will also be notified to all students by email and/or newsletter.

Responsibility of Its Members

It is the member’s responsibility to read the Terms and Conditions before signing the application form. It is the strict understanding that upon completing and signing the membership form, the member is deemed to have read, understood and agreed to be bound by these terms and conditions.

Interpretation

Mazuki Taekwon–do are the sole authority for interpreting clauses set out in these Terms and Conditions. For clarity the following are defined:
Member: Refers to the student to be trained and under whose name the membership application and licence is applied for.
Minor Member: Refers to a minor (child under 18 years) whose parent/guardian has consented to be trained and under whose name the membership application and licence is applied for. Parents/guardian also agree to be bound by these terms and condition. Management/Staff: Refers to the instructors and management of Mazuki Taekwon –Do.
Licence: Refers to a member’s annual subscription for membership to the Mazuki Taekwon-do association and third party insurance.

Complaints

Mazuki Taekwon–Do will deal with and process any issues/complaints under these Terms and Conditions.
Mazuki Taekwon–Do will deal with all its affairs, the conduct of its members or their guests, disputes etc. under the terms set out herein. The management’s decision is final.

Guests Visiting

Mazuki Taekwon–do welcomes guests visiting/viewing the classes. However, all guests must take care when entering, sit in the designated areas, abide with instructions given by management and must abide with its Terms and Conditions. Visitors are not allowed to stand in the training room and are not permitted to take photographs without the strict permission of management.

Member Photographs

The member’s photograph is required to process the member’s application and for administrative purposes.
Mazuki Taekwon–do reserves the right to use photographs of classes, students, instructors, to display them on newsletters, their website and any other advertisements. Any member/parent/guardian who objects to their photographs being used for such purposes should inform the management in writing by way of a formal letter or email.
It must be noted that by signing the consent/enrolment form, its members agree to their photograph being used as detailed above unless it is expressly stated not to by way of a formal letter or email. Retrospective photos cannot be removed from Mazuki newsletters, their website or advertisement material.

Membership Conditions

Each member must complete either an Adult or Junior Consent/Membership Form before he/she can be allowed to take part in any classes. The membership of Mazuki Taekwon–do is not transferable and must only be used by the registered member. Any misuse of the membership will result in the membership being cancelled and classes terminated without a refund of the fees paid. The management of Mazuki Taekwon–do reserves the right to cancel any membership in breach of its rules or conduct, which in the view of the management of Mazuki Taekwon–do is offensive to members and/or staff, brings Mazuki Taekwon-Do in to disrepute or represents a health and safety danger.

Beginner students are allowed two trial lessons to decide if the classes are suitable. See current class information for trial rates. The completed consent forms and membership fees must be paid by the third lesson, upon which full membership is applied for.

Insurance

The information provided on the consent form will be used for the procurement of third party insurance cover for each member whilst training. Members are under a strict duty to declare any medical condition and this duty is on going during training. They should inform Mazuki Taekwon-do of any changes in their medical condition as this can affect their insurance whilst training. It is members responsible to declare the information truthfully knowing that it will be used for insurance purposes also.

Fees/ Prices/ Classes

Every member must pay a compulsory licence fee currently at £19.00 (subject to change) for the third party insurance and membership to the association. A copy of the insurance policy is available for viewing at the member’s request.
Any member wishing to terminate their membership can do so at any time. However, no refunds are offered or given with respect to training fees; licence/membership fees; competition/seminar fees; used clothing/equipment or items on sale unless there are exceptional circumstances such as death of the member. New clothing/equipment must returned be within 28 days in an unused and saleable condition to be eligible for a refund.

Training fees are payable in full by the first lesson of term attended. Term fees, trial lessons payments and Insurance fees are non-refundable unless provided for in these Terms and Conditions. All claims must be submitted in writing or email to Mazuki Taekwon–Do.
Mazuki Taekwon–Do members will be eligible to train at any of the age appropriate classes available.

Mazuki Taekwon–Do normal classes, venues and hours are listed on the website. Such hours may be lengthened or shortened and venues changed at the absolute discretion of Mazuki Taekwon–Do with or without any prior notice been given to members. However, Mazuki Taekwon–Do shall endeavour to give reasonable notice of any lengthening or shortening of such hours, venue changes and when any classes or facilities may not be available.

Mazuki Taekwon–Do shall give the member not less than 10 days written notice, by email or newsletter, of any increases in prices.

Facilities/ Equipment/ Venue

Mazuki Taekwon–do cannot be held responsible for any services or equipment not being available for whatever reason.

Mazuki Taekwon–do reserves the right to make reasonable alterations to the type of facilities provided without notice, to its absolute discretion and Mazuki Taekwon–Do shall not be liable of any loss occasioned by such alterations.

Health And Safety/Restrictions

All members must inform staff of any medical condition that may affect their training before becoming a member and subsequently inform any of change of medical condition. See also note on insurance above.

Each member or parent/guardian of member must confirm that they do not suffer from any injury or illness that may be aggravated by their training. It is each member’s responsibility to seek their doctor’s/medical advice before starting training. Management of Mazuki Taekwon–Do cannot give medical advice and are not qualified so to do.

Strictly no pets are allowed into the buildings with the exception of Guide Dogs.

No member shall attend classes or the premises of Mazuki Taekwon-Do under the influence of alcohol/drugs or any such related substance.

In the interest of safety no glass whether bottle, jar or drinking glass may be taken into the training area. Food should not be consumed in the training hall. No hot drinks allowed. Water may be consumed for rehydration.

Safety And Personal Belongings

Mazuki Taekwon–Do is not responsible for any loss or damage to property of the member or guests visiting. Members should be responsible for their own belongings and personal items such as mobile, telephone and laptop etc. are kept at the owners own risk.
For security reasons please do not bring any jewellery or other valuables into the premises. Mazuki Taekwon–Do does not except responsibility for any such items left on the premises, which are brought in at the member’s risk.

Information on purchasing uniforms and equipment can be obtained from a member of staff of Mazuki Taekwon–Do.

Uniform, Training Attire And Equipment

Training is done barefoot; no footwear can be worn during training. If the member has any specific problems/requirements in respect to footwear then he/she shall inform a member of staff and suitable arrangements can be made with the instructor.

It is suitable for beginner students to train in appropriate tracksuit, PE kit or casual bottoms and top. No jewellery, earrings or metal hair clips should be worn during training. Any items deemed hazardous during training by management must also be removed. Uniforms are available for purchase.

Safety equipment is required for some activities. Members must abide by the recommendations of management as to the suitability of such equipment and its appropriate use.

Information on purchasing uniforms and equipment can be obtained from management/staff.

Termination or Refusal of Classes

The management of Mazuki Taekwon–Do reserve the right to cancel any membership or refuse training in breach of rules or conduct that, in the view of the management of Mazuki Taekwon–Do, is offensive to members and/or staff, represents a health and safety danger or any fees are outstanding.
If for any reason a member wishes to terminate his/her training, then he/she should inform the administration of Mazuki Taekwon–Do by email or in writing.

Members should note that the training/license fees are non–refundable except in exceptional circumstances such as death of the member, and at the discretion of the instructor.

Mazuki Taekwon–do reserves the right to suspend or expel any member whose conduct is such as shall, in its opinion, be injurious to the character of Mazuki Taekwon–do or be detrimental to the interest of its other members. Any member expelled shall forfeit all privileges to Mazuki Taekwon–do.

General Matters

Members must give written notice to Mazuki Taekwon–do of any change of address or email details. Failing such notice, all communication shall be presumed to have been received within 5 days of mailing to the last address notified to Mazuki Taekwon–do.
Mazuki Taekwon–do reserves the right to refuse admission of any member who breaches its terms and conditions.

All members are asked to wear the appropriate form of dress.
Alcohol or smoking is prohibited in and around any training area or facilities used by Mazuki Taekwon–do. Any waiving of these terms and conditions can only be approved by the management of Mazuki Taekwon–do. It is the duty of the students to read the student rules below which governs training etc. Mazuki Taekwon–do advises all potential members of the club to initially observe a lesson and then take part in a trial lesson before becoming a full member of Mazuki Taekwon–do.
For security reasons, please do not bring any jewellery or other valuables on to the premises. Mazuki Taekwon–do does not accept responsibility for any such items left on the premises, which are brought in at the member’s risk.

Important To Note Before Signing

By signing the consent form the member is confirming that they have observed a full Taekwon–do session being taught and agree to these terms and conditions herein OR that they have willingly waived observing a full Taekwon–do lesson, (this includes parents/guardians of junior members if this is applicable, against the advice and recommendation of Mazuki Taekwon–do).

Whilst Mazuki Taekwon–do and their licensed instructors take care to devise and ensure careful and safe training programmes the member should acknowledge that this activity involves elements of risk and danger of accidents, and knowing them that they voluntarily assume the risk.
It is the member’s responsibility to ensure that he/she is capable of undergoing the normal routine of exercises provided by the programme/class. Not all exercises are suitable for everyone and some exercise programme/class may result in injury. Members accept the risk of injury from performing the normal routine of exercises. To reduce the risk, members should consult their Doctor before beginning any programme or class. Mazuki Taekwon–Do accepts no responsibility for loss of or any damage to property of its members or guests, or for injury to members or guests so far as such loss, damage or injury is by law incapable of exclusion.

Student Rules and Code of Conduct

  1. All members must have completed a consent/membership form and all fees must been paid in full.
  2. Students should always be polite and respectful to instructors, fellow students and spectators.
  3. Students suffering from illness or taking any medication that may affect their training should seek medical advice from their doctor and inform the instructor prior to the class.
  4. Students should follow the following dress code:
    1. An clean and pressed official ITF uniform should be worn during lessons, except for beginners who are trialling a lesson.
    2. Toenails should be kept short.
    3. Students train in bare feet, but approved footwear may be worn if there are any foot conditions.
    4. Students should be clean and free from unpleasant odours.
    5. No jewellery should be worn including metal hair clips, watches, bracelets or earrings.
    6. For free sparring, students should wear approved headgear, hand mitts, foot mitts, gum shield and groin guard for males. Shin protectors may also be worn.
  5. Students should observe the following Taekwon-Do etiquette:
    1. Bow before entering or leaving the training hall.
    2. Bow to the instructor when lining up at the commencement and dismissal of the class.
    3. Bow as you approach the instructor. When walking away, take at least two steps back before turning away from the instructor.
    4. Address the instructor by either ‘Sir’ or ’Miss’.
    5. Students who arrive late should wait at the side of the hall before being called to join in by the instructor. But, students should endeavour to arrive on time to avoid disruption.
    6. When tying your belt or adjusting your uniform, turn away from your instructor and seniors, make good your uniform/belt and turn back.
    7. When receiving awards or items from your instructor, receive with both hands.
  6. Students must observe the following safety sparring rules:
    1. Approved safety equipment, mentioned above, must be worn.
    2. No intentional contact should be made. Kicks below the belt, sweeping, grabbing or pushing is prohibited unless under the specific instructions of your instructor.
    3. Under 16 year olds are only allowed to practice power test on junior break boards under the strict supervision of the instructor.
    4. If a student is in doubt of any rules or unsure about aspects of his/her training please clarify with the instructor before proceeding

Mazuki is registered with UK Information Commissioner (Registration No. Z110128X) in compliance with provisions of the Data Protection Act. All personal information processed by Mazuki is in accordance with accepted codes of practise. Your personal data and instructors
As a student or client of Mazuki Taekwon-Do and Mazuki Ltd, your training may be provided by an instructor who is a Taekwon-Do professional instructor. For ease of reference, we refer to them simply as ‘instructors’ throughout this Privacy Notice. Those instructors make decisions about what information is collected about you and may maintain their own set of student records in relation to the training they provide. They are a Data Controller in respect of your personal information which they hold within those records, meaning that they must comply with the data protection legislation and relevant guidance when handling your personal information. To the extent relevant to their practice, you can expect them to handle your information in line with this Privacy Notice. This includes using your personal information as set out in more detail below.
Instructors who work with Mazuki Taekwon-Do and Mazuki Ltd are expected to handle your personal data in accordance with the principles set out within this Privacy Notice. This means that whenever they use your personal data, they will only do so as set out in this Privacy Notice.
Instructors who work with Mazuki Taekwon-Do and Mazuki Ltd may process your personal information off site.
We will collect and store information about you primarily for the procurement of third party member insurance cover and administration. We also use your details to send you newsletters or notifications relevant to our schools and your training. The type of information that we will collect will include – your title and name, known address, contact telephones numbers, next of kin details, medical information that may affect your training and e-mail address.
We do not sell or pass on personal data to third parties. With your consent, some of your personal data is passed on to our governing body (International Taekwon-Do Federation England) to process black belt certificates and seminar/competition entries. We take precautions to ensure the security and confidentiality of your personal data.

What personal information do we collect and use from students?
The personal information that we collect will depend on your relationship with us. We will collect different information depending on whether or not you are already a patient or client of Mazuki Taekwon-Do and Mazuki Ltd.
We may use “special categories of personal information” (otherwise known as “special categories of data”) about you, such as information relating to your physical and mental health. For example, if you are a student we will need to use information about your health in order to develop an appropriate training programme for you.
If you provide personal information to us about other individuals (including medical or financial information) you should inform the individual about the contents of this Privacy Notice. We will process such information in accordance with this Privacy Notice.
In addition, you should note that in the event you amend data which we already hold about you (for instance by amending a pre-populated form) then we will update our systems to reflect the amendments. Our systems will continue to store historical data.

As a student or client of Mazuki Taekwon-Do and Mazuki Ltd, the personal information we hold about you may include the following:

• Contact details, such as postal address, email address and telephone number (including mobile number)
• Financial information, such as account details used for refunds.

• Emergency contact details, including next of kin
• Background referral details

• You enter into a contract with Mazuki Taekwon-Do and Mazuki Ltd for the participation in martial arts training and services
• You use those services
• You complete “Contact Us” forms on the Mazuki Taekwon-Do and Mazuki Ltd website
• You submit a query to us including through our website, by email or by social media
• You correspond with us by letter, email, telephone (some calls may be recorded) or social media, including where you reference Mazuki Taekwon-Do and Mazuki Ltd in a public social media post
• You take part in our marketing activities
• We do not seek or knowingly collect any personal information about children under 16 years of age.

How will we communicate with you?
In order to communicate with you, we are likely to do this by email, telephone, SMS, and/or post. If we contact you using the telephone number(s) which you have provided (landline and/or mobile), and you are not available which results in the call being directed to a voicemail and/or answering service, we may leave a voice message on your voicemail and/or answering service as appropriate.
However:
• To ensure that we provide you with timely updates, newsletters and reminders in relation to our classes (including basic administration information and cancellations, we may communicate with you by email and/or SMS (where you have provided us with your email address)
• To provide you with class information and/or invoicing information, we may communicate with you by email where you have provided us with your email address
• If we have your mobile number or your email address we may use this method of communication to contact you regarding student surveys which are for the purpose of improving our service or monitoring outcomes and are not a form of marketing.

Please note that although providing your mobile number and email address and stating a preference to be communicated by a particular method will be taken as an affirmative confirmation that you are happy for us to contact you in that manner, we are not relying on your consent to process your personal data in order to correspond with you about your training. As set out further below, processing your personal data for those purposes is justified on the basis that it is necessary in order to provide you with martial arts training services.

Surveys
As detailed above, we may contact you to ask you to participate in surveys regarding your trainng with Mazuki Taekwon-Do and Mazuki Ltd. The surveys will largely be sent by email or SMS. This is not a form of marketing and the surveys do not try to sell you any further products or services; it is solely to gather information relating to your experience of Mazuki Taekwon-Do and Mazuki Ltd, for the purposes of improving the quality and safety of the services we offer to current and future students. It is necessary for us to process your personal data in order to contact you with these surveys, on the basis of our appropriate business needs and to improve the quality of martial arts training services we offer (as set out under purpose 7 below). Participation in the surveys is entirely voluntary. You may decide not to complete the surveys and you will have the option to unsubscribe from receiving further survey invitations. You may also be given the opportunity to proactively opt into receiving a call back to further discuss your survey responses. In addition, we may also contact you to invite you to participate in on-line surveys, which are not a form of marketing and are completely voluntary.

What are the purposes for which your information is used?
We may ‘process’ your information for a number of different purposes, which is essentially the language used by the law to mean using your data. Each time we use your data we must have a legal justification to do so. The particular justification will depend on the purpose of the proposed use of your data. Generally, we will rely on the following legal justifications, or ‘grounds’:
• Taking steps at your request so that you can enter into a contract with Mazuki Taekwon-Do and Mazuki Ltd to receive martial arts training services from us.
• We have an appropriate business need to process your personal information and such business need does not cause harm to you. We will rely on this for activities such as quality assurance, maintaining our business records, developing and improving our products and services and monitoring outcomes.
• We have a legal or regulatory obligation to use such personal information.
• We need to use such personal information to establish, exercise or defend our legal rights.
• You have provided your consent to our use of your personal information.
Note that failure to provide your information further to a contractual requirement with us or an instructor may mean that we are unable to set you up as a student or facilitate the provision of your training on Mazuki Taekwon-Do and Mazuki Ltd systems.
We provide further detail on these grounds in the sections below.

Appropriate business needs
One legal ground for processing personal data is where we do this in pursuit of legitimate interests and those interests are not overridden by your privacy rights. Where we refer to use for our appropriate business needs, we are relying on this legal ground.

• Grading and examination information

The right to object to other uses of your personal data
You have a range of rights in respect of your personal data, as set out in detail in the section entitled “Your rights”. This includes the right to object to Mazuki Taekwon-Do and Mazuki Ltd using your personal information in a particular way (such as sharing that information with third parties), and we must stop using it in that way unless specific exceptions apply. This includes, for example, if it is necessary to defend a legal claim brought against us, or it is otherwise necessary for the purposes of your ongoing training.

You will find details of our legal grounds for each of our processing purposes below. We have set out individually those purposes for which we will use your personal information, and under each one we set out the legal justifications, or grounds, which allow us to do so. You will note that we have set out a legal ground. This is because we have to demonstrate additional legal grounds where we are using information which relates to a person’s martial arts training, as we will be doing the majority of the times we use your personal information.
Purpose 1: To set you up as a patient/client on Mazuki Taekwon-Do and Mazuki Ltd’s systems. Legal ground: Taking the necessary steps so that you can enter into a contract with us for the delivery of martial arts training.

Purpose 2: To provide you with martial arts and related services.
Clearly, the reason you come to us is to provide you with martial arts training, and to do so, we have to use your personal information.
Legal grounds:
• Providing you with martial arts and related services
• Fulfilling our contract with you for the delivery of martial arts training

Purpose 3: For account settlement purposes
We will use your personal information in order to ensure that your account and billing is fully accurate and up-to-date.
Legal grounds:
• Our providing you with martial arts and related services
• Fulfilling our contract with you for the delivery of martial arts training
• Our having an appropriate business need to use your information which does not overly prejudice you
• The use is necessary in order for us to establish, exercise or defend our legal rights

Purpose 4: Communicating with you and resolving any queries or complaints that you might have.
From time to time, patients may raise queries, or even complaints, with Mazuki Taekwon-Do and Mazuki Ltd. We take those communications very seriously. It is important that we resolve such matters fully and properly, and in order to do so we will need to use your personal information.

• Our providing you with martial arts and related services
• Our having an appropriate business need to use your information which does not overly prejudice you
• The use is necessary in order for us to establish, exercise or defend our legal rights

Purpose 5: Communicating with any other individual that you ask us to update about your training and updating other instructor and teaching professionals about your training.
In addition, other instructor or teaching professionals or organisations may need to know about your training in order for them to provide you with safe and effective training, and so we may need to share your personal information with them. Further details on the third parties who may need access to your information is set out in purpose 9 below.

• We have a legitimate interest in ensuring that other instructor and teaching professionals who are routinely involved in your training have a full picture of your training
• The use is necessary in order for us to establish, exercise or defend our legal rights

Purpose 6: Complying with our legal or regulatory obligations, and defending or exercising our legal rights
As a provider of martial arts training, we are subject to a wide range of legal and regulatory responsibilities which is not possible to list fully here. We may be required by law or by regulators to provide personal information, and in which case we will have a legal responsibility to do so. From time to time, Mazuki Taekwon-Do and Mazuki Ltd and its practitioners may be the subject of legal actions or complaints. In order to fully investigate and respond to those actions, it is necessary to access your personal information (although only to the extent that it is necessary and relevant to the subject-matter).

• The use is necessary in order for us to comply with our legal obligations
• The use is necessary for establishing, exercising or defending legal claims

Purpose 7: Providing improved quality, training and security (for example, with respect to recorded or monitored phone calls to our contact numbers) including conducting surveys
Mazuki Taekwon-Do and Mazuki Ltd is a quality-conscious organisation, and always looking to learn from students’/clients’ experiences in order to improve the experience for future students/clients. Who do we share your information with?
From time to time, we may share your personal information within our group or with third parties.
Disclosures to third parties: We may disclose your information to the third parties listed below for the purposes described in this Privacy Notice. This might include:
• A teacher or healthcare professional involved in your training
• Other members of support staff involved in the delivery of your training, such as receptionists, porters and teaching assistants
• Anyone that you ask us to communicate with or provide as an emergency contact, for example your next of kin or carer
• Your GP
• Your physiotherapist and other therapists
• Your sports team coach
• Third parties who assist in the administration of your training, such as insurance companies
• Government bodies, including the Ministry of Defence, the Home Office and HMRC
• The police and other third parties where reasonably necessary for the prevention or detection of crime

What marketing activities do we carry out?

An automated decision is a decision made by computer without any human input, and there will be no automated decision-making in relation to your treatment or other decisions which will produce legal or similarly significant effects. We may, however, decide to carry out automated-profiling in respect of your personal information, which is automated processing to evaluate certain characteristics in order for us to provide more tailored marketing. We may then tailor the marketing you see depending on the outcome of that profiling. This could include targeted ads through social media platforms such as Facebook, Twitter, Instagram and LinkedIn.
We have put appropriate measures in place to safeguard any information subject to profiling, particularly by ensuring that any information passed onto third party marketing agencies will be in an anonymous form so that you cannot be identified. How long do we keep personal information for?
We will only keep your personal information for as long as reasonably necessary to fulfil the relevant purposes set out in this Privacy Notice and in order to comply with our legal and regulatory obligations.

International data transfers
We (or third parties acting on our behalf) may store or process information that we collect about you in countries outside the European Economic Area (“EEA”). Where we make a transfer of your personal information outside of the EEA we will take the required steps to ensure that your personal information is protected.
• To the extent that it is necessary to do so, Mazuki Taekwon-Do and Mazuki Ltd may transfer your personal data outside of the EEA to the United States to the following specific types of third party:
o Suppliers of business management software e.g. Office 365 software, Filemaker
o Suppliers of website building software e.g. Heart Internet software

We will only do so to the extent that it is relevant and necessary. The United States and the EEA have in place a framework, known as Privacy Shield, to facilitate compliance with data protection obligations when transferring personal data. Privacy Shield has been assessed by the EU Commission and deemed to provide adequate protection to personal data.

Your rights
Under data protection law you have certain rights in relation to the personal information that we hold about you. These include rights to know what information we hold about you and how it is used. There will not usually be a charge for handling a request to exercise your rights.

In some circumstances, you have the right to request that we delete the personal information we hold about you.
